This Privacy Policy explains what information Aikon Sports, Inc. ("Aikon," "we," "us," or "our") collects, how we use it, who we share it with, and the choices you have. It covers the Aikon mobile app and the website at aikonsports.com (together, the "Service"). Aikon is a training and community app for sports players: a daily workout, a way to find other players, and a map to find where people are playing. We are starting with basketball, with more sports to follow. Please read this together with our Terms of Service.
Aikon is currently offered only to users in the United States.
The Short Version
Here is the whole policy in a few lines. The sections below give the detail.
- We collect what you give us (like your email and date of birth) and your location when you use the map or check in at a gym.
- We use it to run the app, build your workout, show which gyms are active, and connect you with other players.
- We do not sell your data, we do not run targeted ads, and users under 18 can never be public.
- You can request a copy of your data, or delete it, at any time. When you delete your account, everything is gone after a 30 day grace period.
Definitions
To keep this short, a few terms are used throughout. "Service" means the Aikon app and website. "You" means the person using the Service. "Content" means anything you submit, such as a username, a report, or a bug report. "Precise location" means GPS level location from your device. "Minor" means a user under 18.
1. What information do we collect?
In short: what you give us at signup, what the app records as you use it, and your location when you use location features.
Information you give us. Your email address, a password (stored only in secure hashed form by our authentication provider, never in plain text), your date of birth, your username, and your display name.
Information the app creates as you use it. Your friend connections, your presence at a gym (subject to your privacy setting), records of any users you block or report, and progress information such as your XP and rank.
Information you submit on our website. Our website forms collect only the fields you see on the form itself, and nothing more. The presale signup collects your email address, and on the reserve page your city and state. The contact form collects your first name, last name, email address, and message. The careers form collects your first name, last name, email address, phone number, age, location, earliest start date, the role you are interested in, your experience, why you want to join, any links you choose to share, and how you heard about Aikon. These submissions go to Google Sheets (see Section 5). Our website collects nothing about you beyond what you type into these forms.
Information you submit in the app. Bug reports (a category, a description, and basic app context such as the screen and app version) and reports you file about other users for safety reasons.
Location information. When you use the map or check in at a gym, the app reads your device's precise location to measure how close you are to a gym or court. See Section 3 for exactly how this works.
What we do not collect. We do not collect health or fitness measurements such as heart rate, reps, or performance stats, only your XP and rank. We do not currently use third party analytics or advertising tracking software in the app. If we add any third party service in the future, we will name it here and give notice as described in Section 11.
Cookies and tracking. Our website uses only essential cookies needed for it to function. We do not use tracking, advertising, or analytics cookies. Because we do not track visitors across websites or over time, our website does not respond differently to browser "Do Not Track" signals, no visitor is tracked either way.
2. How do we use your information?
In short: to run the app, keep it safe, and communicate with you. We never use it for targeted advertising.
- To provide the Service: create your account, build your daily workout, run the map and gym check in, show which gyms are active, and help you find and connect with other players.
- To keep you and others safe: apply the right protections based on your age, and handle blocks and reports.
- To support you: respond to your bug reports and questions, and send account and security emails.
- To improve the Service: understand which features are used so we can make the app better.
- With your permission: send you news and updates about Aikon, which you can turn off at any time.
3. Location, explained
In short: precise location is used only while you are in the app, only to check your distance to a gym, and we keep only your check in history, not a trail of where you go.
Location is the most sensitive data we handle, so here is exactly how it works:
- The app uses precise GPS only while you are actively using it ("When In Use"). It does not track your location in the background.
- It is used to check your distance to a gym or court (roughly a 150 meter proximity check).
- When you check in or out at a gym, we store a check in and check out record: which user, which gym, and the time. This check in history is the only location information we keep. We do not store a continuous trail of your location.
- You can turn location off at any time in your device settings. The map and check in features will not work without it, but the rest of the app will.
- Your live presence on the map follows your privacy setting (public, friends only, or private). Users under 18 cannot be public. They start on friends only, so they appear on the map only to friends they have accepted, and they can switch to private at any time (see Section 4).
4. Our platform and users under 18
In short: you must be 13 to use Aikon, users 13 to 17 need a parent's permission, and everyone under 18 starts on friends only and can never be public.
You must be at least 13. Aikon is not directed to children under 13, and we do not knowingly collect information from anyone under 13. If we learn that we have, we will delete it and close the account.
Users 13 to 17. Users age 13 to 17 may use Aikon only with the permission of a parent or legal guardian. We use the date of birth you provide to identify users under 18. To protect them, minors are automatically set to friends only and cannot make their account public, though they may choose the stricter private setting at any time. Minors do not appear in browse or search results, and a minor can be found only by someone who already knows their exact username. A minor's presence at a gym is shown only to friends they have accepted, which may include adult users, and is shown to no one at all if the minor chooses private; to everyone else, it is reflected only in that gym's anonymous total player count.
No selling, no targeted ads for minors. We never sell a minor's information and never use it for targeted advertising. Parents or guardians with questions about their child's information can contact us using Section 12.
5. How do we share your information?
In short: we do not sell it, and we share it only with the vendors that run the app, other users per your settings, and where the law requires.
We do not sell your personal information, and we do not show targeted advertising. We do not currently show any ads at all. If we ever introduce ads in the future, they will be general, non-targeted ads, never ads based on your personal information.
Service providers that help us run the Service, only so they can do their job:
- Supabase: our backend, which hosts our database, handles login, stores data, and sends our account emails such as password resets.
- Apple: App Store distribution and iOS services.
- Netlify: hosts our website and password reset page.
- Google: the forms on our website (presale signup, contact, and careers) are delivered and stored using Google Apps Script and Google Sheets. Anything you type into one of those forms is stored in a Google spreadsheet that only Aikon can access.
Other users. Depending on your privacy setting, other users may see your username, display name, and presence at a gym. A user under 18 has their presence shown only to friends they have accepted, or to no one if they have chosen private.
Legal and safety. We may disclose information if the law requires it, to respond to legal process, or to protect the safety, rights, or property of our users, the public, or Aikon.
Business transfers. If Aikon is part of a merger, acquisition, or sale of assets, your information may transfer as part of it, and we will notify you of any change.
6. How long do we keep your information?
In short: while your account is active, and then it is deleted after a 30 day grace period.
- We keep your account and profile information for as long as your account is active.
- We keep your check in and check out history while your account is active, so the app can show gym activity.
- Live check ins expire automatically after a short time (about 90 minutes).
- When you delete your account, deletion runs on a 30 day grace period: you can cancel it any time before the 30th day by logging back in. After 30 days, your data is permanently deleted. We keep nothing except where the law specifically requires us to retain a limited record.
7. What are your rights and choices?
In short: you can see, correct, export, and delete your data, control location, and turn off marketing email.
- Access and export: you can request a copy of your data by emailing us (Section 12).
- Correction: you can update your profile in the app, or ask us to correct it.
- Deletion: you can delete your account in the app at any time, on the 30 day process in Section 6.
- Marketing email: every marketing email has an unsubscribe link, and you can opt out any time. We will still send necessary account and security emails.
- Location: you can turn off location access any time in your device settings.
8. Your U.S. state privacy rights
In short: depending on your state, you have added rights, and we honor them for all U.S. users.
Residents of states with privacy laws (including California, Colorado, Connecticut, Virginia, Texas, Utah, Oregon, and others) have the right to access, correct, delete, and receive a copy of their personal information, and to not be treated differently for using these rights. Because we do not sell personal information and do not use it for targeted advertising, there is nothing to opt out of on that front. To use any of these rights, contact us using Section 12. If we decline a request, you may appeal by replying to our response.
9. How do we protect your information?
In short: database level access controls, hashed passwords, and location gated behind your device.
We use database level access controls so users can only reach data they are allowed to see. Passwords are hashed by our authentication provider and never stored in plain text. Access to precise location is gated behind your device's permission system. The privacy status of users under 18 is enforced at the database level, not just in the app design. No system is perfectly secure, but we work to protect your information and to collect as little as possible.
10. Where is your information processed?
In short: the United States only.
Aikon is offered only in the United States, and your information is processed in the United States. We do not currently offer the Service to users outside the U.S.
11. How will you know if this policy changes?
In short: we update the date at the top, and give notice in the app for big changes.
We may update this Privacy Policy from time to time. If we make a material change, for example if we ever introduce advertising or add a third party service, we will update the "Last Updated" date and, where appropriate, give notice in the Service. Continued use after an update means you accept the revised policy.
